<p>On January 23, 2024, in accordance with requirements under section 129 of the Clean Air Act (CAA), the U.S. Environmental Protection Agency (EPA) performed a 5-year review of the emissions standards and other requirements for the Large Municipal Waste Combustor (LMWC) standards. As part of that action, EPA proposed to eliminate the title V permitting requirement for air curtain incinerators (ACI) that burn only wood waste, clean lumber, and yard waste and are not located at a major source or subject to title V for other reasons. EPA received both supportive and adverse comment letters from citizens, states, advocacy groups, NGOs, and industry stakeholders on the proposed title V provisions. In response to supportive comments received on the January 2024 proposal, this action is finalizing, as proposed, to remove the title V permitting requirements for ACI that only burn wood waste, clean lumber, yard waste, or a mixture of those, and are not located at title V major sources or subject to title V for other reasons. The EPA is finalizing this proposed action now to simplify the compliance obligations for owners and operators of these types of units.&nbsp;The proposal for this action was published 1/23/24 (89 FR 4243) under RIN 2060-AO18.</p>
