        <ABSTRACT><![CDATA[This rulemaking proceeding was initiated in response to a citizen's petition filed in June 2007 under section 21 of the Toxic Substances Control Act (TSCA) requesting that EPA require manufacturers and importers of nonylphenol (NP) and nonylphenol ethoxylates (NPEs) to conduct certain health and safety studies under TSCA section 4. Based on its review of the information submitted in support of the petition, additional information obtained by EPA, and public comments, EPA granted the request to initiate a proceeding to require chronic aquatic toxicity testing. In order to develop a properly tailored test requirement that would provide EPA with sufficient data to make a reasoned evaluation of the environmental effects of NPEs, EPA commenced the proceeding by issuing an advance notice of proposed rulemaking (ANPRM) on June 15, 2009, that solicits public comment on several testing issues prior to the issuance of any proposed rule. EPA subsequently created an Action Plan to consider additional actions for these chemicals.

The Action Plan for NP/NPE was posted to Agency website in August 2010. EPA is currently (July 2011) developing a combined proposed Significant New Use Rule (SNUR) and test rule for the chemicals. The SNUR would address some chemicals that have discontinued production, some chemicals that are only used as intermediates, and some chemicals that are being phased out by 2013-14. The test rule would address health and safety data, and especially environmental effects.]]></ABSTRACT>
