TSCA required EPA to take expedited action on certain persistent, bioaccumulative and toxic (PBT) chemicals. To meet that requirement, in December 2020, EPA issued final rules to reduce exposure to five PBT chemicals, a critical step in the Agency's efforts to protect the health of Americans - including children, workers, and the environment. The Agency is in the process of broadly re-examining how it intends to implement the provisions of amended TSCA, including determining how new executive orders and other Administration priorities will be addressed. EPA is also aware of concerns about these rules, including implementation issues, that have been raised by a range of stakeholders and may consider additional measures, approaches, or revisions that build upon the steps taken thus far. In consideration of the new executive orders and the recently raised concerns, EPA solicited public comments on the final rules. EPA specifically requested comments addressing: (1) whether further exposure reductions could be achieved, including for potentially exposed or susceptible subpopulations and the environment; (2) implementation issues associated with these final rules; and (3) additional or alternative measures or approaches that should be considered. EPA also specifically sought public comment on specifics of recently raised issues regarding the compliance date for the prohibition on the processing and distribution of PIP (3:1) for use in articles, and PIP (3:1)-containing articles. EPA intends to address compliance date issues in this action. If EPA determines to further amend the recent final rules, EPA will address those amendments in one or more future Regulatory Agenda entries.
