On January 4, 2017, EPA promulgated a final rule to improve the competency of certified applicators of restricted use pesticides (RUPs), increase protection for noncertified applicators using RUPs under the direct supervision of a certified applicator through enhanced pesticide safety training and standards for supervision of noncertified applicators, and establish a minimum age requirement for certified and noncertified applicators using RUPs under the direct supervision of a certified applicator. Under that rule, state, tribal, and other certifying authorities were required to submit modification of existing certification plans to EPA for approval. EPA is developing a rule to extend the deadline at 40 CFR 171.5(c) for approval of proposed certification plan modifications submitted by those certifying authorities.
