This rulemaking would make revisions to the Department's existing regulations at 49 CFR part 9 on "Testimony of Employees of the Department and Production of Records in Legal Proceedings." These revisions would clarify that the Department's regulations in part 9 governing employee testimony only apply to current employees of the Department and do not apply to former employees or current or former contractors of the Department. Technical corrections would also be made to update the regulation.
