This rulemaking will amend 14 CFR parts 61, 68, and 91 to implement, without interpretation, the statutory requirements in sections 815 and 828 of the FAA Reauthorization Act of 2024 (Pub. L. 118-63) (the Act). Under section 815, the FAA is directed to issue a final rule to update part 61 to allow pilot examiners to administer a practical test or proficiency check under BasicMed provided both the examiner and the aircraft meet the requirements to operate under BasicMed. Section 828 directs the FAA to update 14 CFR parts 61 and 68 to expand the number of covered aircraft operating under BasicMed. For covered aircraft, this rulemaking will increase the number of occupants from six to seven, increase the maximum takeoff weight from 6,000 pounds to 12,500 pounds, and increase the number of passengers on board from five to six. These amendments will not apply to transport category rotorcraft certified to airworthiness standards under part 29. Amendments to language in part 91 will be made to conform regulations to the amended statutory language in section 828. This rulemaking will also apply consistent usage of the term calendar months for the duration of the comprehensive medical examination, which aligns with terminology in part 61. Finally, this rulemaking will update regulations to permit the FAA to use versions of the FAA Form 8500-8 more current than the previous statutorily-mandated Marcy, 1999, version.
