FMCSA is considering proposals to amend the Lease and Interchange of Vehicles rules for Motor Carriers of Passengers in response to petitions for rulemaking. The proposal would change the scope of the rule by making the 2015 rules inapplicable to leases, interchanges, subcontracts, or reassignments of contracts between motor carriers of passengers that have active passenger carrier operating authority registrations with the FMCSA. For passenger carriers that remain subject to the leasing requirements, FMCSA is considering expanding the permissible emergency-related delay in preparing a lease to include emergencies when passengers are not actually on board a bus and extending the allowable delay to create lease documents after the time the lessee takes exclusive possession and control of the replacement vehicle. The Agency is also considering amendments to the requirements for the location of temporary markings for leased/interchanged CMVs. Finally, FMCSA is considering changing the requirement that carriers notify customers within 24 hours when they subcontract service to other carriers.
