This rule incorporates by reference the expected April 2021 update to the out-of-service criteria for commercial motor vehicles, published by the Commercial Vehicle Safety Alliance. This is an annual update. FMCSA also amends its Hazardous Materials Safety Permit rules to update the current incorporation by reference of the North American Standard Out-of-Service Criteria and Level V Inspection Procedures and Out-of-Service Criteria for Commercial Highway Vehicles Transporting Transuranics and Highway Route Controlled Quantities of Radioactive Materials as defined in 49 CFR part 173.403.
