This rule would incorporate by reference the expected April 2023 update to the out-of-service criteria for commercial motor vehicles, published by the Commercial Vehicle Safety Alliance (CVSA). FMCSA would amend its Hazardous Materials Safety Permit rules to update the current incorporation by reference of the North American Standard Out-of-Service Criteria and Level V Inspection Procedures and Out-of-Service Criteria for Commercial Highway Vehicles Transporting Transuranics and Highway Route Controlled Quantities of Radioactive Materials as defined in 49 CFR part 173.403.
