        <ABSTRACT><![CDATA[This rulemaking would create a new exemption to the make inoperative prohibition in FMVSS part 595. Part 595 establishes exemption to the make inoperative prohibition for certain sections of certain Federal Motor Vehicle Safety Standards (FMVSS) under the limited circumstances when vehicles are modified to be used by persons with disabilities. Otherwise the modifiers of the vehicles would be subject to prosecution for making inoperative equipment required by the safety standards. Bruno manufactures a special seat that rotates and extends outside the doorway to allow mobility-impaired drivers and passengers convenient and safe entry into a vehicle. Provisions of FMVSS No. 202a that become effective September 1, 2009, require higher head restraints that would prevent the operation of such seats. This rulemaking would create a new exemption to make inoperative prohibition for the new head restraint requirement, to allow the continued use of transfer seats for mobility-impaired drivers and passengers. It would also make editorial changes to correct an error in paragraph references regarding similar exemptions to the current FMVSS No. 202.]]></ABSTRACT>
