Section 13 of the PIPES Act (amended) provides a statutory standard for issuing a safety order. Prior to issuing a safety order, the Associate Administrator (AA) must find that a pipeline facility has a condition that posses a pipeline integrity risk to public safety, property, or the environment, and outlines the factors the AA for Pipeline Safety must consider. If a condition exists, an operator must be given notice and an opportunity for a hearing prior to issuing a safety order.
