The Board’s statutes at 49 U.S.C. 10903-10905 govern abandonment of rail lines and discontinuance of rail service by common carriers. Specifically, section 10903 includes the procedures and standard for abandonment or discontinuance; section 10904 concerns offers of financial assistance for continued rail transportation; and section 10905 concerns offers for use of rail properties for certain public purposes. For these statutes, the Board has issued implementing regulations at 49 CFR part 1152, and that part also covers prospective use of railroad rights-of-way for interim trail use and rail banking. Chairman Fuchs intends to conduct a comprehensive, deregulatory review of these regulations to identify ways to streamline procedures, remove paperwork burdens, and strengthen evidence-related provisions.
