<p>On September 18, 2024, the Board proposed regulations that would provide for the prescription of reciprocal switching agreements to remedy inadequate rail service in Docket No. EP 711 (Sub-No. 2),&nbsp;<em>Reciprocal Switching for Inadequate Service</em>. On April 30, 2024, the Board adopted the final rule to provide for the prescription of reciprocal switching agreements as a means to promote adequate rail service through access to an additional line haul carrier, and imposed limited and related data reporting requirements. The rule, with associated regulations codified at 49 CFR part 1145, was subsequently vacated by the United States Court of Appeals for the Seventh Circuit and remanded.&nbsp;Grand Trunk Corp. v. STB, 143 F. 4th 741 (7th Cir. 2025).&nbsp;That remanded proceeding remains pending before the Board. The Board is reviewing the regulations in light of the Seventh Circuit&rsquo;s remanded decision.</p>
