This rule would revise HUD’s regulations for assessing the previous performance in federal programs of certain participants seeking to take part in HUD multifamily housing programs. Specifically, the proposed rule would clarify and simplify the process by which participants that have decision-making authority over their projects demonstrate that they have met their legal, financial, and contractual obligations when participating previously in federal programs. The rule would more clearly identify which individuals and entities must submit information about their prior performance, as well as clarify what kinds of actions would trigger the previous performance review process. The rule would also provide HUD with additional flexibility to request from applicants information that is specific to the applicant, assess the risk they might pose based on prior performance, and to approve or disapprove potential participants. The rule would replace the current prior participation review process and replace the currently required certification form.
