Section 701 of the Housing Opportunity Through Modernization Act (HOTMA) changed the HOPWA formula and terms for grant allocations provided to entities to prevent homelessness for individuals living with HIV or AIDS. This rule seeks to reflect HOTMA’s changes in regulation. The majority of the changes in the rule are merely to align with statute; however, HUD will also contemplate HUD’s ability to reallocate a grantee’s funding due to a lack of capacity to administer Federal funds, as required by statute.
