The Housing and Economic Recovery Act, enacted into law on July 30, 2008, made comprehensive and significant reforms to several HUD programs, including HUD's public housing, section 8 tenant-based and project-based voucher programs. On November 24, 2008, HUD published a notice that provided information about the applicability of certain HERA provisions to these programs. This rule provides the regulations to implement those provisions of HERA that require implementing regulations, as well as conforming regulations for the self-executing provisions of HERA and takes into consideration the comments received on November 2008 notice as well as the May 2012 proposed rule. This rule also make additional changes to the regulations of the Section 8 Tenant-Based Voucher and Section 8 Project-Based Voucher Programs for the purposes of updating certain regulations to reflect current practices and clarifying other regulations, which, based on experience, HUD determined would benefit from clarification.
