The Golden Parachute Payments Regulation is to be amended in order to address its treatment of nondiscriminatory severance plans. The definition of "nondiscriminatory" was found on application to be so narrow that it does not operate to allow any severance plans of those regulated entities that are subject to the rule to make use of the exemption from the definition of "golden parachute payment" that is provided for nondiscriminatory severance plans.
