<p>The rule would establish the procedure for serving&nbsp;FHFA with service of process.&nbsp; Service of process is a jurisdictional prerequisite to instituting a private action. A plaintiff&rsquo;s failure to properly serve a defendant may result in dismissal of the lawsuit.&nbsp; The rule is intended to assist the public by identifying the approved way to serve FHFA with process when&nbsp;FHFA is named in a lawsuit while also addressing FHFA&rsquo;s due process rights to receive notice of pending litigation.&nbsp; The rule would create a procedure that the public may follow to satisfactorily comply with the requirements of the United States Constitution to provide the required due process when seeking to assert claims against FHFA.&nbsp;</p>
