<p>The Fair Housing Act provides that agencies with supervisory or regulatory authority over financial institutions shall administer their programs and activities in a manner affirmatively furthering the purposes of the Fair Housing Act.&nbsp;The final rule would codify in regulation much of FHFA&rsquo;s existing practices and programs regarding fair housing and fair lending oversight of its regulated entities, the Equitable Housing Finance Plan program for the Enterprises, and requirements for the Enterprises to collect and report language preference, homeownership education, and housing counseling information. The final rule would include changes to the Equitable Housing Finance Plan program as it currently exists to promote greater accountability for the Enterprises and public transparency, add oversight of unfair and deceptive practices to FHFA&rsquo;s fair housing and fair lending oversight programs, require additional certification of fair housing and fair lending compliance by the Enterprises, and establish more precise standards related to fair housing, fair lending, and equitable housing for regulated entity boards of directors in carrying out their existing responsibility under FHFA&rsquo;s governance regulation to direct the operations of the regulated entities in conformity with FHFA regulations. FHFA&rsquo;s inclusion of this rule is based on feedback from the public received through a Request for Input (RFI) in September 2021 and public listening sessions in September of 2021 and June of 2023 that included a variety of stakeholders including industry participants, researchers, and community groups. Participants described the need for FHFA and the Enterprises to undertake actions to support equity in the housing markets and provided valuable input on program goals and design.</p>
