        <ABSTRACT><![CDATA[Section 17 of the Consumer Product Safety Act (CPSA) and section 14 of the Federal Hazardous Substances Act (FHSA) contain provisions relating to the sampling, examination, reconditioning, and refusal of admission of products imported or offered for import into the United States. Current regulations governing the administration of imports are found at 16 CFR 1500.265 et seq. These regulations were promulgated in 1972 (38 FR 27012, Sept. 27, 1973, as amended at 57 FR 28605, June 26, 1992) and do not reflect current operational reality. 

Staff is preparing for Commission consideration a proposed rule that would replace the current regulations governing imports and contain a new part dedicated solely to import procedures. The new part would provide direction for the sampling, examination, and detention of products; the presentation of testimony and evidence by claimants to those products in order to resolve the detention; and the refusal of admission of those shipments that are not in compliance. Also covered would be the conditional release of products under the customs bond to bring products into compliance and processes for asserting liens against future imports made by importers, owners, and consignees of noncompliant products that are destroyed at Government expense. The new part would eliminate certain outdated references contained in the current regulations.]]></ABSTRACT>
