On April 10, 2019, CPSC staff submitted to the Commission a briefing package and draft Request for Information (RFI), seeking information about possible changes to the Commission’s Standard for the Flammability of Clothing Textiles, at 16 CFR part 1610, including information about the equipment and procedures specified in the standard and possible ways to update those provisions, as well as information about the possibility of adding spandex to the list of fabrics that are exempt from the testing requirements in the standard. On April 17, 2019, the Commission voted to approve publication of the RFI. On April 23, 2019, the RFI was published in the Federal Register. After reviewing comments received in response to the RFI, as well as additional relevant information, staff submitted a briefing package to the Commission on September 30, 2020, recommending updates to certain equipment and procedures specified in the standard. On August 24, 2022, staff submitted to the Commission a briefing package recommending issuing a notice of proposed rulemaking (NPRM), under the Flammable Fabrics Act (15 U.S.C. 1191-1204), to clarify existing provisions, expand permissible equipment and materials, and update equipment requirements that are outdated. On September 2, 2022, the Commission voted to approve publication of the NPRM. The NPRM was published on September 14, 2022. The written comment period on the NPRM closed on November 14, 2022. Staff will prepare a final rule briefing package for the Commission in FY 2023.
