On April 28, 2021, staff submitted an advance notice of proposed rulemaking (ANPRM) briefing package for Commission consideration concerning fire hazards associated with recreational off-highway vehicles (ROVs), utility terrain vehicles/utility task vehicles (UTVs), and all-terrain vehicles (ATVs), as well as debris-penetration hazards association with ROVs and UTVs. The Commission published the ANPR on May 11, 2021. Staff is evaluating the comments on the ANPRM. The standard development organizations (SDOs) for off highway vehicles have indicated they will publish updated standards for ATVs, ROVs, and UTVs in 2023. Staff continues to engage the SDOs for off highway vehicles to develop voluntary standard requirements to reduce fire hazards associated with ATVs, ROVs, and UTVs. Staff will assess the updated voluntary standards.  If staff assesses that the voluntary standards do not adequately address the fire hazard risk associated with the vehicles, staff will prepare an NPRM briefing package related to OHV fire hazards.
