GSA is amending the Federal Management Regulation (FMR) by amending the provisions for the sale of personal property through the Federal Asset Sales program. This rule published as a proposed rule at 75 FR 40763 on July 14, 2010 under RIN 3090-AJ04, did not receive any comments regarding the recommended revisions. However, in the interim, GSA reconsidered whether the decentralized model for sales created under the eGov initiative was the most advantageous model for the Government and the taxpayer.  As a result, GSA considered moving to a different model, and decided not to publish the final rule until a final decision could be reached.  The decision was ultimately made not to revise this existing sales model.  GSA recognizes that the existing model makes it easier for citizens and businesses to locate billions of dollars’ worth of Government assets for sale and to effectively improve the promotion of Government sales through a centralized, citizen-centric web portal solution.  Therefore, the rule is being published as a final rule based on the proposed rule of July 14, 2010.  As part of the recent GSA review, text reminding agencies of the guidance regarding the inclusion of photographs of the personal property to be sold has also been added.  Encouraging the use of photographs to the greatest extent possible can only improve the screening and continued use of excess or surplus property.
