The National Indian Gaming Commission (Commission) is updating the minimum internal control standards for gaming equipment used with the play of Class II games to ensure that the regulations continue to meet the needs of the Indian gaming industry. The Commission periodically revises these standards to ensure uniformity among its regulated entities, safeguard the integrity of the industry, and protect consumers. This rulemaking updates the minimum internal control standards for gaming equipment associated with Class II gaming to ensure they meet the ever-changing needs of the Indian gaming industry and is designed to keep regulated entities in line with current technology, ensure the costs and benefits of the Government’s regulation of such parties is balanced, and safeguard the integrity of the Indian gaming industry. The Agency’s proposal to update this rule was first presented to tribal stakeholders in a Dear Tribal Leader letter on June 9, 2021, announcing its tribal consultation plan and topics for calendar year 2021, including proposing this update. The Agency provided a follow-up Dear Tribal Leader letter on December 10, 2021, noting its intention to focus on regulations with implications for technology and NIGC processes to protect tribal assets. Following a series of virtual sessions seeking feedback in January 2022, tribal stakeholders submitted their written comments to the Agency. The Agency continues to review the feedback provided and take it under advisement for next steps.
