<p>This rulemaking would amend the NRC&rsquo;s regulations to require new and revised site-specific technical analyses and permit the development of site-specific criteria for low-level radioactive waste acceptance based on the results of these analyses. The rulemaking proposes to authorize the near-surface disposal of certain Greater-Than-Class C waste streams and provide for Agreement State licensing of these waste streams. Licensees of currently operating low-level radioactive waste facilities that do not plan to accept Greater-Than-Class C waste or significant quantities of long-lived radionuclides after the effective date of this rulemaking would continue to comply with current regulations. The NRC engaged with stakeholders by issuing draft versions of preliminary proposed rule language, and requesting public feedback.&nbsp;</p>

The NRC staff provided recommendation to the Commission in CY 2020 to coordinate the part 61 and Greater-Than-Class-C (RIN 3150-AK00) rulemaking activities (SECY-20-0098). In SRM-SECY-20-0098, dated April 2022, the Commission directed staff to integrate the Part 61 and the Greater-than-Class-C rules into one rulemaking. This rulemaking, formerly titled, &quot;Low-Level Radioactive Waste Disposal,&quot; combines several rulemakings on low level radioactive waste.
