This rulemaking would establish an optional technology-inclusive regulatory framework for use by applicants for new commercial advanced nuclear reactors. The regulatory requirements developed in this rulemaking would use methods of evaluation, including risk-informed and performance-based methods, that are flexible and practicable for application to a variety of advanced reactor technologies. The NRC engaged with the public by providing periodic release of preliminary proposed rule language, holding public meetings with stakeholders, and requesting public feedback.

In SRM-SECY-18-0026, dated July 14, 2022 (ML22195A097), the Commission disapproved the draft proposed rule, Financial Qualifications Requirements for Reactor Licensing [NRC-2014-0161; RIN 3150-AJ43] and directed the staff to address financial qualifications during the development of this proposed rule, and to solicit stakeholder feedback on financial qualifications. In SRM-23-0021, dated March 4, 2024 (ML24064A047), the Commission approved, in part, the NRC staff's draft proposed rule to establish a voluntary risk-informed, performance-based, and technology-inclusive regulatory framework for commercial nuclear plants. On November 25, 2024, the NRC extended the comment period for the proposed rule from December 30, 2024, to February 28, 2025 (89 FR 92609).
