The U.S. Office of Personnel Management (OPM) is proposing to amend 5 CFR section 842.504 and 5 CFR section 843.308 to comply with the statutory language requiring a specific calculation for the earnings ratio when a full year of service subject to the Federal Employees Retirement System (FERS) was not performed. This rule will clarify that OPM calculates a new earnings ratio after each break in FERS civilian service. The rule also will clarify that the same calculation applies to the supplementary annuity paid to survivors of deceased retirees.
