The Office of Personnel Management (OPM) is proposing to remove 5 CFR part 845 and subparts M, N, and R of 5 CFR part 831; amend 5 CFR part 835 to include updated regulations to administer the debt collection activities under the Civil Service Retirement System and the Federal Employees Retirement System; and make conforming changes to 5 CFR part 841. The current regulations reference title IV, which has been replaced by title 31, and do not incorporate any of the changes that were set forth by the Debt Collection Improvement Act of 1996. As a result, OPM needs to update its debt collection regulations to incorporate these statutory changes. OPM also needs to amend its regulations to ensure they reflect precedential decisions that affect the debt collection regulations since the last update in 1995.
