        <ABSTRACT><![CDATA[DoD, GSA, and NASA were proposing to amend the Federal Acquisition Regulation (FAR) to provide regulatory coverage revising subpart 9.5, Organizational Conflicts of Interest, relocating the coverage to a new subpart 3.12, and adding clauses at 52.203.  

This proposed rule was preceded by an Advance Notice of Proposed Rulemaking (ANPR) to gather comments from the public with regard to whether and how to improve the FAR coverage on organizational conflicts of interest (OCI).  

The case was placed on hold due to the priority of implementing new statutory contracting requirements in the National Defense Authorization Act of 2009 (the Act) (Pub. L. 110-417).  However, section 841 of the Act mandated a review of the FAR coverage of organizational conflicts of interest within 12 months of its enactment, i.e., October 14, 2009.  This proposed rule fulfills that requirement.

This case was closed on September 30, 2010 regarding a proposed approach to addressing the comments received on the DoD Organizational Conflicts of Interest Rule (DFARS Case  2009-D015) implementing the statutory contracting requirements in the National Defense Authorization Act of 2009  (Pub. L. 110-417).  It was necessary to ensure that the DoD OCI rule and the proposed FAR rule were not in conflict.  As a result, FAR Case 2007-018 has been closed and a new FAR case (FAR Case 2011-001) was opened on October 8, 2010.]]></ABSTRACT>
