This rule will amend the list of domestically nonavailable articles under the Buy American Act and the protocols to update the list. This rule is being issued in accordance with paragraph (b) of section 25.104 of the Federal Acquisition Regulation (FAR) and section 9 of Executive Order 14005 titled "Ensuring the Future Is Made in All of America by All of America’s Workers.” DoD, GSA, and NASA published an advance notice of proposed rulemaking in May of 2020 seeking inputs from the public that will assist in identifying domestic capabilities and for evaluating whether some articles on the list at FAR 25.104(a) should be removed because they are now mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities and of a satisfactory quality. The feedback is being considered in the development of the proposed rule.
