Title: Polychlorinated Biphenyls (PCBs) Disposal Amendments | |
Abstract: The ANPRM solicited comments on alternate disposal methods for non-liquid PCBs and invites public input on modifications to the PCB disposal regulations. In February 1990, several parties petitioned EPA under Section 21 of TSCA to amend the regulations at 40 CFR 761, which govern the disposal of PCBs, and issue an interpretive rule or declaratory order construing the existing PCB disposal regulations. In responding to the petition, EPA agreed to initiate a regulatory investigation to determine whether or not to amend the disposal regulations. After analyzing the comments received in response to the ANPRM, a proposed rule was drafted to address alternative disposal methods for newly identified scenarios such as large volume solids; mixed wastes such as PCB/radioactive wastes; and other issues, such as disposal of household wastes, small capacitors, and used paints. This notice solicited comments on a modification to the disposal regulations which would allow for the recognition of PCB waste management activities under other Federal or State authorities. After analyzing comments received in response to the NPRM, a final rule will be drafted promulgating more than 50 changes, additions and deletions to the current regulations.
