Abstract: The Organic Foods Production Act of 1990 (OFPA) states that the Secretary shall establish an organic certification program for producers and handlers of agricultural products that have been produced using organic methods. The OFPA provides for three proposed actions by the Department of Agriculture: (a) the accreditation of State and private certifying agents for the Secretary, which includes provision for the collection of reasonable fees from producers, certifying agents, and handlers who participate in the program; (b) the establishment of a national list of natural substances prohibited, and synthetic substances allowed in organic production and handling; and (c) the development of national standards and procedures to be used in organic production, processing and handling, with the requirement that any product labeled as organically produced will have to be certified once the program is implemented (except for producers with less than $5,000 gross sales). The OFPA also calls for establishment of a National Organic Standards Board (NOSB), notices of meetings, and notices of hearings for standards for livestock products. | |
