Title: ●Determination of Concentration of Respirable Coal Mine Dust 
Abstract: This proposal will address the United States Court of Appeals' final decision and order in National Mining Association v. Secretary of Labor, issued September 4, 1998. This NPRM will include a joint finding between the National Institute for Occupational Safety and Health and MSHA that single, full-shift measurements will accurately represent the average dust concentrations to which miners are exposed. This proposal will address the Mine Act's requirement that miners' exposure to respirable coal dust be below the applicable standard on each and every shift. This proposal will present the use of single, full-shift respirable dust exposure measurements collected by MSHA to determine noncompliance when the applicable respirable coal dust standard is exceeded.
