Title: Ownership and Control--Redesign
Abstract: This rule would replace the April 21, 1997, interim rule published to comply with the January 31, 1997, decision of the U.S. Court of Appeals. It will further clarify the definition and application of the terms "owned and controlled" and "owns or controls" in the permitting and enforcement processes. In developing this rule, we will examine current permitting and emforcement issues in order to ensure continued effective implementation of secgtion 520(c) of the Surface Mining Control and Reclamation Act.
