Statement of Need: The Indian Gaming Regulatory Act (IGRA) provides that the Chairman shall have the authority to levy and collect civil fines against a tribal operator or management contractor of an Indian gaming operation for any violation of IGRA, any regulation prescribed by the Commission, or tribal regulations, ordinances, resolutions approved by the Chairman. The Commission has determined that regulations are necessary for the assessment, notification, and collection of debts owed the NIGC resulting from fines assessed by the Chairman. |

Summary of the Legal Basis: IGRA expressly authorizes the Commission to "promulgate such regulations and guidelines as it deems appropriate to implement the provisions of the [Act]." (25 U.S.C. 2706(b)(10)). The Commission relies on this section of the statute to authorize the promulgation of standards for collecting civil fines assessed by the Chairman for violations of the IGRA, NIGC regulations, or tribal regulations, ordinances, or resolutions approved by the Chairman. |

Alternatives: The Commission has no alternative but to promulgate this debt collection procedure for gaming facilities operated on Indian lands. |

Anticipated Costs and Benefits: The potential benefits to this regulatory action are to establish and define for the regulated community the procedure by which the Commission will enforce the collection of civil fines assessed by the Chairman. This regulatory action will provide the Commission with a process for the efficient and effective collection of civil fines. |
