Abstract: The Department intends to update its rulemaking record concerning this regulation by publishing a second notice of proposed rulemaking. The regulation would provide guidance as to what constitutes "adequate consideration" under section 3(18) of ERISA for assets other than securities for which there is a generally recognized market.
