Title: ●Limitations on Issuance of Commercial Drivers' Licenses With a Hazardous Materials Endorsement | |
Abstract: This rule amends the Federal Motor Carrier Safety Regulations to prohibit States from issuing, renewing, transferring, or upgrading a Hazardous Materials Endorsement for a CDL: unless and until the U.S. Department of Justice has first conducted a background records check of the applicant; and the U.S. Department of Transportation has determined that the applicant does not pose a security risk which would warrant denial of the Hazardous Materials Endorsement. This interim final action implements Sec. 1012 of the USA Patriot Act of 2001. This action is significant because of substantial public and congressional interest and safety implications. | |
