Title: ●Criteria and Procedures for Proposed Assessment of Civil Penalties | |
Abstract: This rule would revise the Mine Safety and Health Administration?s (MSHA) statutory penalties found in sections 110(a), 110(b), 110(c), and 110(g) of the Mine Act and the specific penalty amounts established in 30 CFR part 100 as mandated by the Debt Collection Improvement Act of 1996 (DCIA). The DCIA required that civil penalties be increased by up to 10 percent within 6 months of its enactment. This was accomplished by a final rule published in the Federal Register, 63 FR 20032, April 22, 1998. It also required subsequent increases at least once every 4 years using a formula based on the Consumer Price Index. MSHA is issuing a final rule to satisfy that requirement. | |
