Abstract: The purpose of this rule is to implement the following discretionary provisions of the Child Nutrition and WIC Reauthorization Act of 2004, Public Law 108-265, concerning WIC vendor management: 1) requires State agencies to notify vendors of an initial violation when a pattern of violations is required before documenting a subsequent violation, unless it would compromise an investigation; 2) requires a State agency to maintain a list of infant formula wholesalers, distributors, and retailers licensed in the State, and formula manufacturers registered with the U.S. Food and Drug Administration, and requires authorized vendors to only purchase infant formula from those entities on the State agencys list; and, 3) establishes restrictions on the provision of incentive items to participants by vendors for which most food proceeds result from WIC purchases.
