Statement of Need: Oil and coal-fired electric utility steam generating units were added (December 20, 2000) to the list of source categories to be regulated under section 112 of the Clean Air Act, as amended. On January 30, 2004, EPA proposed to remove oil- and coal-fired electric utility steam generating units from the list so that they could be regulated under section 111 of the Clean Air Act.

Summary of the Legal Basis: Sections 111 and 112 of the Clean Air Act, as amended.

Alternatives: Alternative approaches to regulating electric utility steam generating units were proposed on January 30, 2004.

Anticipated Costs and Benefits: It is anticipated that this rule will result in significant costs to the affected industry, including Federal, State, and local entities that own/operate electric utility steam generating units. These costs will be identified as the final rule is developed.

Risks: Risk information will become available as the final rule is developed.
