Title: Clean Air Interstate Rule (Formerly Titled: Interstate Air Quality Rule) | |
Abstract: The Clean Air Act's "good neighbor" provisions require that a State take steps to prevent emissions from sources located within its boundaries from interfering with a downwind State's ability to meet national ambient air quality standards (NAAQS). On March 10, 2005, EPA signed the Clean Air Interstate Rule (CAIR) to address the interstate transport of sulfur dioxide (SO2) and nitrogen oxides (NOx) emissions that contribute significantly to nonattainment, or interfere with maintenance, of the fine particle (PM2.5) and/or 8-hour ozone NAAQS in downwind States. SO2 and NOx are precursors to fine particle formation and NOx is a precursor to ground-level ozone formation. Fine particles and ozone are associated with thousands of premature deaths and illnesses each year. The CAIR covers 23 States and the District of Columbia with respect to the PM2.5 NAAQS, and 25 States and the District of Columbia with respect to the 8-hour ozone NAAQS. Each upwind jurisdiction must revise its State implementation plan to include control measures to reduce emissions of SO2 and/or NOx. Reducing these upwind precursor emissions will assist downwind areas in achieving the NAAQS. The emissions reductions are to be implemented in 2 phases. The CAIR includes model cap and trade rules for power plants that States can choose to adopt to meet the CAIR requirements in a flexible, highly cost-effective manner. | |
