Title: ●NESHAP for Hazardous Air Pollutants for Hazardous Waste Combustors | |
Abstract: Section 112 of the CAA requires that EPA establish NESHAP for the control of hazardous air pollutants (HAP) for both new and existing major sources. The CAA requires the NESHAP to reflect the maximum degree of reduction in emissions of HAP that is achievable. This level of control is commonly referred to as MACT (for Maximum Achievable Control Technology). EPA published NESHAP for hazardous waste combustors on April 20, 2004, and we published the final rule on October 12, 2005. Following promulgation of the hazardous waste combustor final rule, the Administrator received four petitions for reconsideration pursuant to section 307(d)(7)(B) of the Clean Air Act from the Ash Grove Cement Company, the Cement Kiln Recycling Coalition, the Coalition for Responsible Waste Incineration, and the Sierra Club. Under this section of the CAA, the Administrator is to initiate reconsideration proceedings if the petitioner can show that it was impracticable to raise an objection to a rule within the public comment period or that the grounds for the objection arose after the public comment period. Among these petitions for reconsideration, EPA is being asked to reconsider approximately twenty aspects of the final rule. This workgroup will engage in a rulemaking process to address those issues for which EPA decides to grant reconsideration. | |
