Title: Hazardous Materials: Revision to Requirements for Transportation of Batteries and Battery-powered Devices and Harmonization With the United Nations Recommendations, International Maritime Dangerous
Abstract: The Federal hazardous materials transportation law (Federal hazmat law; 49 U.S.C. 5101 et seq.) requires PHMSA to align the HMR with international transport standards and requirements to the extent practicable (see section 5120). This rulemaking would amend the Hazardous Materials Regulations to maintain consistency with international standards. The amendments are necessary because of recent changes to the International Maritime Dangerous Goods (IMDG) Code, the International Civil Aviation Organization´s (ICAO) Technical Instructions for the Safe Transportation of Dangerous Goods and the United Nations (UN) Recommendations on the Transport of Dangerous Goods. Harmonization serves to facilitate international transportation while ensuring the safety of people, property, and the environment. The most significant revisions include (1) incorporation by reference of the updated ICAO Technical Instructions, IMDG Code and UN Recommendations; (2) amendments to the Hazardous Materials Table (HMT) to add, revise or remove certain proper shipping names, hazard classes, packing groups, special provisions, packaging authorizations, bulk packaging requirements, passenger and cargo aircraft maximum quantity limitations and vessel stowage provisions; (3) revisions to requirements for the transportation of fuel cells; and (4) expanded exceptions for small quantities of certain hazardous materials. In addition, this rulemaking would revise and clarify battery and battery-powered devices.
