Title: ●Adding the Hellbender and Subspecies (Ozark Hellbender and Eastern Hellbender) to CITES Appendix III and Amending the CITES Regulations
Abstract: We propose to add the hellbender (Cryptobranchus alleganiensis), and its two subspecies, the Ozark hellbender (Cryptobranchus alleganiensis bishopi) and the eastern hellbender (Cryptobranchus alleganiensis alleganiensis), to appendix III of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES). Hellbenders are amphibians endemic to the United States. With this action, we can adequately monitor international trade in the taxa, determine whether exports are occurring legally under State law, and determine whether to take further measures under CITES or other laws to conserve these species. We also propose to remove the requirement that we publish a proposed and final rule for a CITES appendix-III listing from our regulations at 50 CFR 23.90(e). We propose instead to publish a notice of intent with request for comments, followed by a decision, for a CITES appendix-III listing. This change would ensure that we are consistent in the way that we handle rulemaking and nonrulemaking actions.
