EPA/WATER RIN: 2040-AF11 Publication ID: Fall 2010
Title: Water Quality Standards (Numeric Nutrient Criteria) for Florida's Lakes and Flowing Waters
Abstract: EPA is under a Consent Decree deadline to promulgate numeric nutrient water quality criteria (which are elements of water quality standards) for the State of Florida's lakes and flowing waters by October 15, 2010. EPA made a determination on January 14, 2009 that numeric nutrient water quality criteria are necessary for the state to meet the requirements of the Clean Water Act (CWA). In June 2010, EPA and Plaintiffs filed a joint notice with the Court extending the deadlines for promulgating numeric nutrient criteria for Florida's estuaries and coastal waters , flowing waters in south Florida (including canals), and the downstream protection values for flowing waters into estuaries. The new deadlines are November 14, 2011 for proposing the estuarine and coastal waters criteria, and August 15, 2012 for publishing a final rule for these three categories. The original deadline of October 15, 2010 remains in place for EPA to finalize numeric nutrient criteria for Florida's lakes and other flowing waters (streams and springs).
