Title: ●Option to Extend Services (DFARS Case 2011-D003)
Abstract: This rule amends the Defense Federal Acquisition Regulation Supplement (DFARS) to provide a DoD alternative to the FAR clause "Option to Extend Services" in order to clarify and appropriately limit the use of this specialized authority in response to two General Accountability Office decisions. The DFARS clause will be included in contracts for services to provide the Government with a means for continuing performance without a break in service when a follow-on contract is not in place at the end of the current contract's performance period ( whether that is the basic contract period or an option period). The clause can be exercised only in extreme circumstances. The intent of the clause is to provide the Government the unilateral right to a brief extension of services, at current contract rates (unless there is a new Department of Labor (DOL) wage determination), and for a period not to exceed a total of six months (per contract, including all options). The rule will not result in any additional burdens on small businesses. It merely relocates an existing Government tool from the FAR to the DFARS and aids improved communications between DoD and the contractor when extreme circumstances may require continued performance. Therefore, any economic impact is expected to be minimal.
