Title: Presumptive Service Connection for Diseases Associated With Persian Gulf War Service: Functional Gastro-Intestinal Disorders | |
Abstract: The Department of Veterans Affairs (VA) is amending its adjudication regulations concerning presumptive service connection for functional gastro-intestinal disorders (FGID) associated with service in the Southwest Asia theater of operations for which there is no record during service. This amendment is necessary to implement a decision of the Secretary of Veterans Affairs that there is a positive association between service in Southwest Asia during certain periods and the subsequent development of FGID. The intended effect of this amendment is to establish presumptive service connection for these diseases based on service in the Southwest Asia theater of operations during the Persian Gulf War. | |

Overall Description of Deadline: The Secretary of Veterans Affairs must determine within 60 days of receiving an IOM report whether a presumption of service connection is warranted for any disease discussed in the report. If the Secretary determines that a presumption is warranted for any disease, he must issue proposed rules within 60 days after making the determination and must issue final rules within 90 days following publication of the proposed rule. |
