NLRB RIN: 3142-AA07 Publication ID: Fall 2011
Title: Notification of Employee Rights Under the National Labor Relations Act
Abstract: The Board has issued a rule requiring all employers subject to the National Labor Relations Act (NLRA) to post in their workplaces notices informing employees of their rights under the NLRA. The rule applies to labor organizations in their capacity as employers. The intended effects are to increase knowledge of NLRA rights on the part of employees and to better enable the exercise of those rights; a beneficial side effect may be to promote compliance with the NLRA by both employers and unions. The rule provides that an employer that fails to comply with the requirements of the rule may be found to have committed an unfair labor practice. In appropriate circumstances, the Board may find that a failure to post the notice warrants tolling the 6-month statute of limitations for filing an unfair labor practice charge; it may also consider a knowing and willful failure to post the notice as evidence of unlawful motive in an unfair labor practice proceeding.
