Title: Hazardous Materials: Failure to Pay Provision | |
Abstract: This rulemaking is in response to the enactment of MAP 21. MAP 21 provides that PHMSA prohibit a person from conducting regulated hazardous material operations if the person fails to pay a civil penalty. The regulations must: (1) set forth procedures to require a person who is delinquent in paying civil penalties to cease any regulated activity until payment has been made or an acceptable payment plan has been arranged; and (2) ensures that the person is notified in writing and is given an opportunity to respond before the person is required to cease the activity. | |
