Title: ●Federal Motor Vehicle Safety Standards; Certification Requirements  
Abstract: This rule will require U.S. domiciled motor carriers to operate vehicles that have been certified according to Federal Motor Vehicle Safety Standards (FMVSSs). It will also explain how the FMVSS certification would be confirmed when inspections are conducted. This rule is necessary because the Federal Motor Carrier Safety Administration (FMCSA) has no authority to enforce the FMVSS or importation regulations. This rule will help to ensure that only vehicles subject to the FMVSSs at the time of manufacture, or vehicles that are legally imported into the U.S. in accordance with the National Highway Traffic Safety Administration (NHTSA) and the U.S. Customs and Border Protection regulations, are used by U.S. domiciled carriers. This rulemaking is a response to an Office of the Inspector General recommendation, “Work with the National Highway Traffic Safety Administration and U.S. Customs and Border Protection to develop and implement a risk-based solution, in compliance with the National Traffic and Motor Vehicle Safety Act of 1966, to target enforcement against U.S. domiciled passenger carriers whose vehicles do not meet Federal Motor Vehicle Safety Standards.”
